1. Introduction
Thank you for visiting FSCO Group. These terms and conditions (“Terms of Service”), together with our Privacy Policy, govern the use of the broking service (“Service”) provided by FSCO Group (“we”, “us”, “our”) to any business registered with us (“you”, “your”).
FSCO Group is registered in Ireland (company number [Company Number]).
FSCO Group may engage with various third-party providers and partners to deliver our services to you.
2. Limitations of What We Offer
FSCO Group is a broker, not a direct finance provider.
Our services are intended solely for business-related purposes. We do not offer debt counselling or financial advice.
We cannot guarantee that our services will lead to a successful outcome, and we are not obligated to provide our services to you at any given time.
Our services rely on information from third-party sources, over which we have no control. This information may contain errors or inaccuracies.
If we are not aware of your specific requirements, it is your responsibility to ensure that any options presented to you meet your business needs.
The content and information we provide as part of our services may not always be current or accurate and may change without prior notice. Therefore, all content is provided for general informational purposes only.
To enable free access to our services, we exclude liability to the maximum extent allowed by law for any inaccuracies, service failures, or errors. We do not offer any warranty or guarantee regarding the accuracy, completeness, timeliness, performance, or suitability of the information provided through our services.
To the extent permitted by applicable law, both parties are only liable for direct losses that are a foreseeable consequence of their breach or negligence (excluding fraud or intentional misconduct).
Nothing in these terms will limit or exclude liability for death, personal injury, or any other liability that cannot be excluded or limited by law.
While our services are generally free of charge to you, FSCO Group may receive commission or compensation from financial providers for successful introductions.
Our services are not intended as advice, and should not be relied upon as the basis for any decision. We recommend you seek independent financial, legal, and/or tax advice regarding any finance application or agreement.
You use and download any information from our service at your own risk. It is your responsibility to ensure that your software is capable of detecting and removing any potential viruses in any downloaded data.
The presence of third-party sites, links, or information via our service does not imply endorsement, recommendation, or any responsibility for their content.
We reserve the right to modify, suspend, or discontinue our services at any time without notice.
3. Your Usage and Responsibilities
By using the FSCO Group service, you agree to promptly notify us of any changes to the details you have provided. It is your responsibility to ensure that all information you provide is complete, accurate, up-to-date, and truthful. You are solely responsible for creating backup copies and replacing any information you provide via our service, at your own cost.
You agree that FSCO Group (and our service providers) may conduct identity verification and credit checks on you, as well as your owners or directors. You and your owners or directors acknowledge that credit reference agencies link records of you and anyone you have designated as a financial associate (e.g., someone with whom you share a joint credit account). These links will remain on your and your associate’s credit reference files until you or your associate successfully request disassociation with the credit reference agencies. FSCO Group (and any finance provider) may consider this information when assessing credit references.
You are responsible for keeping your username and password secure. When these credentials are used to log in, we will assume that you are the person providing instructions, and you will be liable for any actions unless and until you notify us of any changes. You are responsible for any activity resulting from failure to protect your login details. We may refuse or disable access at our sole discretion, without notice, if it is lawful to do so.
If you wish to cease using our service at any time, you may contact us to request deactivation of your account. We will remove any third-party data access you have provided within a reasonable timeframe. We will retain historical data as described below.
If you have agreed to pay for any aspect of our service, you acknowledge that failure to make payment may result in the withdrawal of your rights to use the service.
You agree not to use our service in a way that harms our reputation, and you agree to comply with all applicable laws and regulations, including the General Data Protection Regulation (GDPR).
You agree to indemnify and hold FSCO Group, our staff, officers, group companies, and partners harmless from any loss, damage, or claims made by third parties because of your breach of these terms.
We will make reasonable efforts to provide support for the service during office hours by email at support@fsco.group, via web chat, or by phone.
4 Your Usage and Responsibilities
By using the FSCO Group services, you agree to notify us immediately of any changes to the details you have provided. You are responsible for ensuring that all information you provide is complete, accurate, up-to-date, and true in every respect. It is your responsibility to bear the cost of backing up any data or information you submit via our services.
You agree that we (and our Providers) may conduct identity verification and credit checks on you, your business owners, or directors. You acknowledge that credit reference agencies may link records about you with anyone you have identified as a financial associate, such as joint account holders. These associations will remain on your credit record until you or your associate successfully request disassociation from the relevant credit reference agencies.
You are responsible for keeping your account username and password secure. Any activity through the FSCO Group services will be assumed to have been conducted by you when accessed with your login credentials. You are liable for all actions taken under your account unless you notify us promptly of any unauthorized access. We may suspend or disable your access to the service at our sole discretion if necessary.
If you choose to stop using the services, you may request to deactivate your account, and we will remove any third-party data access you’ve provided within a reasonable timeframe. However, we will retain historical data as required by law.
If you have agreed to pay for certain services, non-payment may result in the withdrawal of your access to FSCO Group services.
You agree not to misuse our services in a way that damages our reputation or violates any applicable laws, including the General Data Protection Regulation (GDPR). You are also responsible for ensuring compliance with all relevant legal requirements.
You agree to indemnify FSCO Group, its employees, officers, affiliates, and partners against any loss, damage, or claims arising from your violation of these terms.
